1. Agreement to Terms
By accessing our website, usbfork.com.au ("Site"), or engaging our services, you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of the terms, you may not access our services.
2. Services
usbfork ("we", "us") provides technology consulting services, including but not limited to software integration, backend development, AI implementation, and cloud architecture ("Services"). The specific scope of Services for any project will be defined in a separate proposal or Statement of Work. The "Service Packages" listed on our Site are offered with a defined scope and price. Any work outside this scope will be considered a custom project and will require a separate agreement.
3. Payments
Fees for our "Service Packages" are as listed on our Site and are processed securely via our third-party payment processor, Stripe. For custom projects, payment terms will be outlined in a formal proposal, typically requiring an upfront deposit. All prices are listed in Australian Dollars (AUD).
4. Intellectual Property
We retain ownership of all pre-existing materials, code, methodologies, and know-how used to provide the Services. Upon receipt of full payment for a project, the client ("you") will own the final, delivered work product (the "Deliverables"). You grant us a perpetual, worldwide, non-exclusive licence to use the Deliverables for our archival and portfolio purposes.
5. Limitation of Liability
To the maximum extent permitted by Australian law, usbfork shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your access to or use of our Services. Our total liability for any claim arising out of these Terms or our Services will not exceed the total amount you paid us in the 3 months prior to the claim.
6. Governing Law
These Terms shall be governed and construed in accordance with the laws of Western Australia, Australia, without regard to its conflict of law provisions.
7. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms.
